Groupon, the daily deal giant, is about to get a new source of revenue. As first reported by The Wall Street Journal, lawyers in New York state will be permitted to peddle their legal services via deal sites.
The New York State Bar Association committee on professional ethics said that attorneys may market legal services on a “deal of the day” or “group coupon” website. Of course, the ethics committee said that the advertising cannot be misleading or decpetive. Further, there will be no lawyer-client relationship until the attorney can check for conflicts and competence to provide the service.
Lawyers who find they cannot provide the service must provide a full refund. In the case of termination by the coupon purchaser, the buyer is entitled to a refund subject to the lawyer's reasonable value of services or quantum meruit claim.
